These Terms & Conditions (“Terms”) govern your access to and use of SurfaceX, including our website, mobile applications, services, and any related features (collectively, the “Service”). By accessing or using SurfaceX, you agree to these Terms. If you do not agree, do not use the Service.

If you are using SurfaceX on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

“SurfaceX,” “we,” “our,” and “us” refer to the SurfaceX entity identified in the “Contact” section below.

You must be at least 13 years old (or the minimum age required in your country) to use SurfaceX. If you are under the age of majority where you live, you may use the Service only with permission of a parent or legal guardian.

You agree that:

• The information you provide is accurate and current.

• You will not use the Service if you are prohibited by law from doing so.

To use certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials (including OTP access).

• All activities that occur under your account.

• Not sharing your account with others.

If you believe your account has been compromised, you must notify us immediately.

We may suspend or terminate accounts that violate these Terms or pose risk to other users or the Service.

SurfaceX allows you to post content, including text, photos, videos, live streams, messages, and other materials (“User Content”).

You retain ownership

​

You own the User Content you create and post. SurfaceX does not claim ownership of your User Content.

You grant us a license

​

To operate the Service, you grant SurfaceX a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, distribute, display, and perform your User Content only as needed to provide the Service (e.g., showing your post to the audience you selected).

This license ends when your User Content is deleted from the Service, except where:

• The content has been shared with others and they have not deleted it.

• We are required to retain content for legal, security, or compliance reasons.

• Backup and caching copies exist temporarily.

You represent and warrant that:

• You have all rights needed to post the User Content.

• Your User Content does not violate laws or third-party rights.

Content Visibility and Privacy Controls

SurfaceX offers privacy and audience controls. You understand that:

• No system is perfectly secure.

• Sharing content with others may allow them to save or share it outside SurfaceX.

• Some information (e.g., your username or profile basics) may be visible depending on your account settings and how you interact on the platform.

Acceptable Use (Community Rules)

You agree not to misuse SurfaceX. You may not:

• Harass, bully, threaten, or shame others.

• Share content that is illegal, exploitative, or promotes violence.

• Impersonate another person or misrepresent your identity.

• Post or distribute spam, scams, or misleading content.

• Attempt to hack, reverse engineer, disrupt, or overload the Service.

• Collect or scrape data from the Service without permission.

• Use SurfaceX for unauthorized commercial promotions, automation, or mass messaging.

We may remove content or restrict accounts that violate these rules, at our discretion.

Reporting, Moderation, and Enforcement

SurfaceX may review, remove, or restrict User Content or accounts if we believe it:

• Violates these Terms or our rules,

• Violates law,

• Creates risk or harm,

• Infringes intellectual property,

• Is abusive, deceptive, or unsafe.

We are not required to monitor all content, but we may do so to keep the Service safe and functional.

Intellectual Property (SurfaceX Content)

The Service, including our software, design, text, graphics, logos, and trademarks (“SurfaceX Content”), is owned by SurfaceX or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or SurfaceX Content unless we give you written permission.

Third-Party Services and Links

SurfaceX may include links or integrations with third-party services (e.g., device OS features, analytics, payment providers). We do not control these third parties and are not responsible for their content, policies, or actions.

Your use of third-party services is governed by their terms.

Purchases, Subscriptions, and Refunds (If Applicable)

If SurfaceX offers paid features:

• You agree to pay all applicable fees and taxes.

• Subscriptions renew automatically unless cancelled before renewal.

• Refunds, if any, are handled according to the policy shown at purchase or the applicable app store rules (Apple/Google).

We may change pricing or plans with notice where required.

Termination

You may stop using the Service at any time. You may also request account deletion, subject to the Privacy Policy.

We may suspend or terminate your access if:

• You violate these Terms,

• We must comply with legal obligations,

• Your account creates risk to users or the Service.

Upon termination, your right to use the Service ends immediately.

Disclaimers

​

SurfaceX is provided on an “as is” and “as available” basis. To the maximum extent permitted by law:

• We do not guarantee the Service will be uninterrupted, error-free, or secure.

• We do not guarantee accuracy, reliability, or availability of content.

• We are not responsible for User Content posted by others.

Limitation of Liability

To the maximum extent permitted by law, SurfaceX and its affiliates will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages,

• Loss of profits, data, goodwill, or business opportunities,

• Any damages resulting from your use of or inability to use the Service.

If SurfaceX is found liable, our total liability will not exceed the greater of:

• The amount you paid to SurfaceX in the last 12 months (if any), or

• ₹5,000 (or local equivalent)

(Some jurisdictions don’t allow certain limitations. In that case, some of these may not apply to you.)

Indemnification

You agree to defend, indemnify, and hold harmless SurfaceX and its affiliates from claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service,

• Your User Content,

• Your violation of these Terms,

• Your violation of any law or third-party rights.

Changes to These Terms

​

We may update these Terms from time to time. If changes are material, we will provide notice (e.g., in-app notice or email). Continuing to use the Service after the update means you accept the revised Terms.

16) Governing Law and Dispute Resolution

Governing law: These Terms are governed by the laws of India, without regard to conflict of law rules.

Disputes: If a dispute arises, you agree to first contact us to try to resolve it informally. If not resolved, disputes will be handled in the courts located in state of incident, unless applicable law requires otherwise.

Miscellaneous

• If any provision of these Terms is found invalid, the rest remains in effect.

• We may transfer our rights and obligations as part of a merger, acquisition, or sale of assets.
